SparkLink Ltd Terms and Conditions

Welcome to SparkLink Ltd (“SparkLink,” “we,” “us,” or “our”). These terms and conditions (“Terms”) form the agreement between SparkLink Ltd and you (“Client,” “Customer,” “you,” or “your”) regarding our services.
You agree to be bound by these Terms by booking or using our services. If you do not agree, please refrain from using our services.
1 – PARTIES
“Client” refers to any individual or business commissioning services from SparkLink Ltd. “SparkLink” refers to SparkLink Ltd and its representatives.
2 – GENERAL
2.1 SparkLink reserves the right to refuse or decline work at our discretion.
2.2 These Terms override any other terms presented by the Client unless otherwise agreed in writing.
2.3 By commissioning SparkLink, you agree to these Terms.
3 – CHARGES BY TIME TAKEN (“Rolling Rates”)
3.1 Charges include the cost of materials (plus up to 25% markup) and time spent onsite or sourcing materials, billed in 30-minute intervals (minimum 1 hour).
3.2 Parking fees and Congestion Charges are payable by the Client.
3.3 Estimates provided are not binding and actual costs may vary.
3.4 Travel time, material sourcing, and preparation time may be charged.
3.5 Estimates are valid for 30 days unless stated otherwise.
4 – DIAGNOSTIC / FAULT-FINDING WORK
4.1 An initial diagnostic visit is fully chargeable. If further work is needed, SparkLink will explain findings and next steps.
5 – FIXED PRICE WORK
5.1 Where a fixed price is agreed, it covers specified work only. Changes in scope, conditions, or material costs may result in price revisions.
6 – CANCELLATION
6.1 Cancellations less than 48 hours before a booking may incur a £20 cancellation charge.
6.2 Same-day cancellations are subject to minimum booking charges.
6.3 If SparkLink arrives onsite and cannot access the property, full minimum charges apply.
7 – PAYMENT
7.1 Payment is due immediately upon completion unless otherwise agreed.
7.2 Invoice customers must pay within 30 days.
7.3 Failure to pay may result in legal action.
7.4 No certificates, reports, or guarantees will be issued until full payment.
8 – DEFERRED PAYMENT (“DP”)
8.1 SparkLink may request pre-authorization on a payment card at booking.
8.2 Payment details are handled securely and are not stored after processing.
9 – COMPLAINTS
9.1 If dissatisfied, contact SparkLink within 12 months of work completion.
9.2 We may request evidence of faults to assess rectification without additional cost.
9.3 If you arrange third-party repairs without notice to SparkLink, our liability is voided.
10 – COLLATERAL DAMAGE
10.1 Clients must clear work areas before our arrival. SparkLink cannot be held responsible for accidental damage to personal items left on-site.
10.2 Time spent moving items is chargeable.
11 – GUARANTEES
11.1 Our work and supplied parts are guaranteed for 12 months unless misuse, third-party alterations, or other exclusions apply.
11.2 Drainage, blockages, and work against advice are not guaranteed.
12 – INDEMNITY
12.1 Clients indemnify SparkLink against third-party claims arising from breaches of these Terms.
13 – LIMITATIONS OF LIABILITY
13.1 SparkLink’s liability is limited to:
- Rectifying defects as per the Guarantee.
- Death or injury caused by our negligence.
- Repair costs for property damage directly caused by our negligence.
13.2 We are not liable for indirect or consequential loss, including lost profits.
14 – FORCE MAJEURE
14.1 SparkLink is not liable for delays or non-performance caused by events beyond our reasonable control (e.g., natural disasters, strikes, supply issues).
15 – CUSTOMER’S RESPONSIBILITY
15.1 Clients must:
- Provide power, water, and safe access.
- Inform SparkLink of hazards onsite (e.g., asbestos, dangerous wiring).
16 – REMOVAL OF WASTE MATERIALS
16.1 Unless agreed, waste disposal is the Client’s responsibility.
17 – FROZEN PIPES / WEATHER CONDITIONS
17.1 SparkLink is not liable for damage to frozen pipes or weather-related obstacles outside our control.
18 – VARIATIONS TO TERMS
18.1 Any changes to these Terms must be in writing and signed by both parties.
19 – GOVERNING LAW
These Terms are governed by the laws of England and Wales.
